This includes, but is not limited to, internal network connectivity, server programs, server hardware, switches, and routers. This agreement shall NOT cover any condition outside the control or unpreventable by ACS. These conditions include, without limitation, acts of any governmental body, war, insurrection, sabotage, armed conflict, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of or interruption or delay in telecommunications of third party services, virus attacks or hackers, failure of third party software (including, without limitation, ecommerce software, payment gateways, chat, statistics or free scripts) or inability to obtain raw materials, supplies, customer's internet provider availability, or power used in or equipment needed for provision of this SLA; Failure of access circuits to the ACS's Network or its upstream providers, unless such failure is caused solely by ACS or ACS's equipment; Scheduled maintenance and emergency maintenance and upgrades; DNS issues outside the direct control of ACS; Customer's acts or omissions (or acts or omissions of others engaged or authorized by customer), including, without limitation, custom scripting or coding (e.g., CGI, Perl, HTML, ASP, etc), any negligence, willful misconduct, or use of the Services in breach of ACS's Terms of Service and Acceptable Use Policy; E-mail or web mail delivery and transmission; DNS (Domain Name Server) Propagation; Any other outages elsewhere on the Internet that hinder access to your account; ACS is also not responsible for browser or DNS caching that may make your site appear inaccessible when others can still access it. ACS will guarantee only those areas considered under the control of ACS.

    

3. ACS assumes no responsibility for, and disclaims all liability in respect of, the content, accuracy, completeness or timeliness of any third-party websites to which this site is linked and the privacy practices and/or quality of products or services provided by or advertised on or in connection with any such third-party websites.

    

4. All textual, graphical and other content currently created by or for ACS and appearing on this site is the sole and exclusive property of ACS. ACS and its affiliates also owns a copyright in this site as a collective work and/or compilation and in the selection, coordination, arrangement and enhancement of such content. Republication or citation of any content generated by this site without ACS's written consent is expressly prohibited.
